Terms of Service

3.1 Anonymous and Registered Use

You may use certain features of the Service without creating an account (device-local mode). In this mode, your study data is stored only on your device and is not synced to the cloud. To access the full Service — including cross-device sync, subscriptions, and the Pass Guarantee — you must create an account using Apple Sign In or Google Sign In.

3.2 Account Responsibility

You are responsible for maintaining the security of your account and for all activities that occur under your account. You agree to notify us immediately at [email protected] if you become aware of any unauthorized use.

3.3 One Account Per User

Each user may maintain only one account. Creating multiple accounts to circumvent restrictions, abuse promotions (including the Pass Guarantee), or for any other purpose is prohibited and may result in termination of all associated accounts.

4.1 Free and Paid Tiers

The Service offers both free and paid subscription tiers. Free users have access to a limited question bank (Free Pack) and diagnostic assessments. Paid subscribers ("Pro" users) have access to the full question bank, mock exams, personalized study plans, spaced repetition, and the Pass Guarantee program.

4.2 Subscription Plans

We offer three auto-renewing subscription plans: Monthly, Quarterly, and Annual. All subscriptions are processed through Apple In-App Purchase and are subject to Apple's terms and refund policies. We do not process payments directly and do not have access to your payment card details.

4.3 Auto-Renewal and Cancellation

Subscriptions automatically renew at the end of each billing period unless you cancel at least 24 hours before the end of the current period. You may cancel your subscription at any time through your Apple ID settings (Settings → Apple ID → Subscriptions). Cancellation takes effect at the end of the current billing period — you retain access to paid features until that date.

4.4 Price Changes

We reserve the right to change subscription prices. Any price changes will take effect at the start of your next billing period following reasonable notice.

6.1 Eligibility Requirements

To be eligible for the Pass Guarantee, you must meet all of the following criteria:

• Hold an active Quarterly or Annual Pro subscription on the date you sit for your official exam (Monthly subscriptions are not eligible)
• Have actively used ExamPal for at least 14 days prior to your exam date
• Have completed at least 70% of the available question bank for your specific exam, or completed at least 2 full mock exams for that exam
• Submit your Pass Guarantee claim within 30 calendar days of receiving your official exam results
• Provide reasonable documentation of your exam result (see Section 6.2)

6.2 Claim Process

To submit a claim, email [email protected] with the subject line "Pass Guarantee Claim" and include: (a) your ExamPal account email, (b) the exam name and date, and (c) official documentation showing your exam result — such as a score report from the testing organization or a screenshot of your results from the exam provider's portal. We will review claims within 5 business days.

6.3 Remedy

If your claim is approved, you will receive 3 months (90 days) of Pro access at no charge, applied to your existing account. This benefit is provided as an account extension, not a monetary refund. The extension has no cash value and is non-transferable.

6.4 Limitations

• The Pass Guarantee is limited to one claim per exam attempt.
• ExamPal reserves the right to deny claims that do not meet the eligibility criteria, contain falsified documentation, or where abuse or fraud is reasonably suspected.
• ExamPal reserves the right to modify, suspend, or discontinue the Pass Guarantee program at any time with 30 days' notice to active subscribers.
• This program does not constitute a guarantee of exam success. Exam outcomes depend on individual effort, knowledge, and exam conditions beyond our control.

7.1 Our Content

All content available through the Service — including practice questions, answer explanations, terminology glossary, study plans, graphics, user interface design, and software code — is the property of VIISLABS or its licensors and is protected by copyright, trademark, and other intellectual property laws.

7.2 Content Protection

Exam question content is protected through encrypted transmission (AES-256-GCM) and signature verification to prevent unauthorized access, extraction, or redistribution.

7.3 Limited License

We grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Service for your personal, non-commercial study purposes. This license does not include the right to:

• Copy, reproduce, distribute, or publicly display any content from the Service
• Reverse engineer, decompile, disassemble, or otherwise attempt to derive the source code of the app
• Use content for commercial purposes or to create competing products
• Share, sell, or redistribute practice questions or explanations

9.1 "As Is" Basis

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

9.2 Educational Tool Only

The Service is an educational study aid. Practice questions and explanations are provided for learning purposes only and do not constitute legal, professional, or other expert advice. Practice questions may not reflect the exact content, format, or difficulty of any actual exam.

9.3 No Guarantee of Results

We do not guarantee that use of the Service will result in passing any exam. Exam outcomes depend on individual effort, knowledge, exam conditions, and other factors outside our control. The Pass Guarantee program (Section 6) is a specific promotional benefit with eligibility requirements and does not alter this disclaimer.

12.1 Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of California, United States, without regard to its conflict of law provisions.

12.2 Dispute Resolution

Any dispute arising out of or relating to these Terms or the Service shall first be attempted to be resolved through good-faith informal negotiation. If the dispute cannot be resolved informally within 30 days, either party may pursue resolution through binding arbitration administered by JAMS under its Streamlined Arbitration Rules, held in San Francisco, California. You agree that any dispute resolution proceedings will be conducted on an individual basis and not in a class, consolidated, or representative action.
